Recent Successes by the Prince Lobel Cannabis Team

In 2014, Prince Lobel became one of the first Massachusetts law firms to represent clients in the marijuana industry.  Since then, our Cannabis Team has been involved in advising its medical marijuana business clients with respect to all issues facing the Cannabis industry, including licensing, permitting, insuring, formation, structuring, raising capital, threatened litigation, supply contracts, and taxes.  We also advise clients on the new Adult Use statute and pending regulations, as well as the recently allowed conversion from nonprofit to for-profit medical marijuana entities.

We represent many businesses involved in the marijuana industry, including dispensaries, cultivators, manufacturers, retailers, property owners, management companies, and prospective investors.

Happenings Last Month:

Conversions Begin

After a variety of discussions with the staff of the DPH and Office of the Secretary of State, Prince Lobel became the first firm in Massachusetts to successfully convert a non-profit RMD to a for-profit business corporation, and then to obtain the approval of the DPH and the Office of the Secretary of State to complete the Client’s conversion into a Massachusetts limited liability company.  This process was initially delayed, as the DPH had not yet developed its own procedures when the application was presented.

Others are now following that process.

A Third Boston Dispensary is Permitted

Another recent success came for Prince Lobel’s Cannabis Team on November 14, 2017, when, after a long community outreach process, Prince Lobel attorney Mike Ross of our Cannabis Team successfully obtained a vote in support of a conditional use permit for a medical marijuana dispensary on Newbury Street for one of our clients.  The hearing made national news headlines when a retired venture capitalist provided controversial testimony strongly in opposition of the permit.  What is without controversy is that this was a great outcome for our client!

This is the fourth medical marijuana dispensary approved in City of Boston, three of which have been permitted by the Prince Lobel Cannabis Team.  In addition, our team is working on permitting a fourth dispensary, which is currently pending approval in Dorchester.
