Proprietary Specifications on Public Works Projects and Their Impact on a Level Playing Field for Bidders

Chapter 30 § 39M of the Massachusetts
General Laws, which applies to public works projects valued at more than
$10,000, was enacted to create a level playing field for those bidding on a
public works project.  The term public
works refers to the installation of sewer lines, mains, related utilities, and
the construction of roads, bridges, and the like. The goal of this statute is
to ensure that the public work to be performed is done so at the best price by
the lowest eligible and responsible bidder.
