Media and First Amendment Practice Group chair Rob Bertsche was quoted in The Providence Journal regarding a recent case in which the publication filed a challenge to a judge’s order that reporters not contact jurors after a high-profile murder trial. The paper alleges that the order violates its First Amendment rights. Bertsche was involved in the case through his representation of The New England First Amendment Coalition and The New England Newspaper and Press Association Inc., both of which have been asked to be heard in this matter and had “grave concerns” over the judge’s actions. “Post-trial access to jurors in a criminal trial is essential to the press and public’s right to report to the public about the workings of the judicial system,” Bertsche wrote.
