Bertsche argued that reporter Jillian Fennimore has “no direct knowledge” of the April 2007 incident concerning town council member Marilyn Devaney, who faces charges when she allegedly threw a packaged curling iron at a clerk. Devaney’s lawyer, Janice Bassil opposed Bertsche’s counter to the subpoena, claiming that even though Fennimore did not have first hand knowledge to the incident, she had access to the supplemental police report marked “Not for Public Release.” This then led to the source who then singled out Devaney by the Waltham Police Department.
