Supreme Judicial Court Rules on Massachusetts Public Bidding Process and Low Bidder’s Responsibility to Perform

A recent article by Construction Law Practice Group Chair Hugh
J. Gorman III discusses the SJC ruling concerning the public bidding statute
that requires projects to be awarded to the lowest eligible and responsible bidder.
The court decided that the awarding authority may legally conduct an
independent investigation into the low bidder’s responsibility to perform.
