Many employers are familiar with the annual EEO-1 reporting requirements to the Equal Employment Opportunity Commission. Certain states (including California and Massachusetts) also have similar annual filing requirements but require disclosure of corresponding pay and additional demographic information. Below is a summary of 2025 filing requirements.
Federal EEO-1 Report
- Applies to employers with 100 or more employees
- Must provide information on race and gender
- Due: Not yet announced
California EEO-1 Report
- Applies to employers with 100 or more employees
- Must provide information on race, gender, ethnicity and pay
- Due: May 14, 2025
Massachusetts EEO-1 Report
- Applies to employers with 100 or more employees in Massachusetts
- Must provide information on race, gender, ethnicity and pay
- Due February 3, 2025
Note that at least for 2025, the Massachusetts Executive Office of Labor and Workforce Development has confirmed that employers need not create a Massachusetts specific form nor provide pay data. Accordingly, for 2025 Massachusetts employers may simply file their most recent Federal EEO-1 report.
