Jeffrey Pyle was quoted in the most recent issue of Massachusetts Lawyers Weekly concerning a recent case in which he and Hugh Gorman III obtained a permanent injunction that protects the integrity of the state’s affirmative action program for public construction projects. The firm represents Federal Concrete, Inc., a woman-owned concrete firm, in a challenge to the state’s practice of allowing businesses owned by persons of Portuguese origin to participate in the state’s affirmative marketing program, despite the absence of any evidence that Portuguese-owned firms have suffered from discrimination in the construction industry. Pyle said he was “heartened” by the decision, which prohibits participation by these “highly capitalized, high-volume companies,” and thereby opens up the playing field for minority- and women-owned firms that are truly disadvantaged.
