New York Releases FAQ for 60-Day Cannabis License Application Window Starting Next Week

The New York State Office of Cannabis Management has just published a 45-page Frequently Asked Question guide: NYS ADULT FAQ. This FAQ provides an important framework for understanding the requirements to apply for and maintain a cannabis-licensed business. Of course, the FAQ document does not fully cover the more than 400 pages of regulations and application materials. Prince Lobel stands ready to help applicants fill in the blanks.

CAURD APPLICANTS WHO RECEIVED PROVISIONAL APPROVAL SHOULD APPLY THROUGH THE GENERAL APPLICATION WINDOW. The FAQ recites that, “[d]ue to the pending litigation challenging the validity of the CAURD program, provisional CAURD licensees may want to apply for an adult-use dispensary license during this application window.” We agree. The sample application for a cannabis license specifically asks whether the applicant is a CAURD entity. The outcome of the litigation over the CAURD program is uncertain, so it is critical that provisional CAURD licensees submit their applications.
